Obras derivadas: ¿qué son?

La licencia Art Libre, traslada el modelo del copyleft y la GPL a producciones artísticas y dice sobre las modificaciones u obras “consecutivas”:

2.3 LIBRE MODIFICACIÓN:

Es libre de modificar copias de la obra original o consecutiva, en parte o en totalidad, de acuerdo con las condiciones de libre difusión o representación de la copia modificada previstas por el artículo 2.2.
Si así lo manifiesta, el autor del original podrá autorizarle a modificar directamente la obra original en los mismos términos y condiciones que las copias.

La Licencia de Arte Libre fue la primera en hablar de “obra consecutiva” como aquellas “contribuciones aportadas a la obra en formación, por autores que ejercen el derecho de reproducción, difusión y modificación que les otorga la licencia.”

En 2004 aparece el sistema de Licencias Creative Commons, como una respuesta a cierta dificultad (e invariabilidad) en la aplicación de las Licencias copyleft. CC es una potente combinación de licencias modulares que le permiten al creador elegir entre opciones de comercialización, modificación y redistribución, así como incluir su licencia en medios digitales de un modo simplificado.

Una de las opciones de CC es la posibilidad de que otro realice “obras derivadas”, modificando la obra original. En base a esta posibilidad realizamos la experiencia del Proyecto Derivadas, en junio de 2006.

Un grupo de artistas participantes de una muestra Interfaces Córdoba-Posadas fue invitado a licenciar sus obras bajo CC (cc-by-nc-sa-ar-2.5) y otro grupo de artistas fue invitado a realizar obras derivadas.

Las obras originales a derivar: ¿qué es un original en el siglo XXI?

Las obras licenciadas bajo CC que participaron de la derivación incorporan, como muchas de las producciones del arte contemporáneo, procedimientos de remix, cita, apropiación o combinaciones de esos recursos. Analizando las obras disponibles para la derivación, los artistas encontraron que muchas de ellas ya eran obras derivadas de otras previas.

Esto señaló aristas interesantes del asunto: por un lado, si bien reconocíamos el grado de similitud de estos procedimientos reconocidos en las obras “originales” con la derivación propuesta, advertíamos también la diferencia implicada en buscar o no una forma legal que nombrara esa “filiación de origen”.

¿En qué radicaba esta sutil diferencia generada por la licencia? Básicamente, que las obras originales con procedimientos de derivación, estaban pensadas para circular en el mundo del arte: un espacio donde las leyes de derechos de autor están tácitamente suspendidas para los artistas (no para los espectadores y eso queda demostrado cuando alguien quiere tomar fotografías de obra).

El espacio del arte es para sus protagonistas, los artistas, un espacio donde es posible decir, hacer, mostrar lo que en otros espacios sería considerado ilegal, inmoral, incorrecto, imprudente, insano, etc.; y en muchos casos en esa transgresión reside la eficacia de la obra.

Entre sus atributos, el espacio de la institución-arte permite a sus autores criticar la autoría violando los derechos de autor, dentro de una tradición que tiene casi un siglo de legitimidad.

Interfaces Córdoba-Posadas: una muestra curada por Carina Cagnolo y Francisco Alli Brouchoud, que se realizó en Argentina (Córdoba, Buenos Aires y Posadas) en 2006, en la que participaron 13 artistas. La muestra formaba parte de una serie de cruces entre regiones de Argentina, que tuvo 5 ediciones en 10 ciudades de Argentina.

Un punto clave en esa operación de crítica (o irreverencia) a la figura tradicional del autor es el status de ambos autores: el que cita, y el que es citado.

En el mundo del arte, no cualquiera puede permitirse la operación de la copia, apropiación
o similar: sólo los autores reconocidos como tales pueden hacerlo. Y tampoco ellos
elegirán a cualquiera para citar, puesto que la eficacia de la operación depende de que se
pueda reconocer el original de referencia, caso contrario estaríamos frente a un simple (y
mal visto) plagio.

Los autores citados en estas obras originales son de 2 tipos: pertenecen al mundo del arte (Cerrito, en Bustos) o son clásicos de la cultura, reconocibles por todos (canciones de Sandro, Rafaela Carrá en Pequeño Bambi; el diseño de señalética en Sprenk, el juego
HF2, jugado por todos los escolares en Argentina, en Jacobo y menos explícitamente: el
fotógrafo de plaza y la “estética antropológica” en Orge)

Las fotos de la obra de Aníbal Buede merecen una nota aparte: siendo el procedimiento
central de la obra el intercambio que se propone al espectador, las fotos en sí se
convierten en ejemplares tipo de álbum familiar: su formalidad no es relevante a la obra
de Buede, aunque si su carácter documental, especialmente en Córdoba (porque toda
una comunidad (se) reconoce en ellas); en el mismo sentido en una foto familiar es
intrigante como documento de la vida de alguien, aunque sea un desconocido.

La obra en sí, como otras obras conceptuales, no es susceptible de ser protegida bajo el
derecho de autor convencional: con elementos en permanente mutación, sólo el concepto
de intercambio permanece, pero incluso las reglas varían con cada “salida”.
